GIFT CARD TERMS AND CONDITIONS

The following terms and conditions (the “Terms and Conditions”) apply to any Mariasha Couture gift card originally purchased at any participating Mariasha Couture, accepting and retaining a Mariasha Couture Gift Card or using a Mariasha Couture Gift Card, you agree to these Terms and Conditions. Mariasha Couture reserves the right to change, amend or terminate the Terms and Conditions of the Mariasha Couture Gift Card program at any time with or without notice in our sole discretion.

 

Use of the Mariasha Couture Gift Card

 

You may use the Mariasha Couture Gift Card only to purchase eligible merchandise and pay for services at any Mariasha Couture location.

 

Redemptions/Balances

 

Your use of the Mariasha Couture Gift Card is limited to the current dollar value held on the card. You may obtain your balance by presenting your Mariasha Couture Gift Card at any Mariasha Couture location. Mariasha Couture Gift Cards may not be redeemed for cash, except to the extent required by law.

Restrictions

 

You may not return, resell or use any Mariasha Couture Gift Card for any unauthorized advertising, marketing, sweepstakes or other promotional purposes.

 

No Expiration Date/Service Charges

 

The Mariasha Couture Gift Card has no expiration date, service charges or dormancy fees.

 

Promotional Cards

 

These Terms and Conditions do not apply to gift cards or other stored value cards that are given away for free or distributed as a reward, incentive, or as part of a marketing or promotional program (“Promotional Cards”). Promotional Cards may have different terms and expiration dates to the extent permitted by applicable law.

 

Lost or Stolen Cards

 

Protect your Mariasha Couture Gift Card as if it were cash and safeguard the Mariasha Couture Gift Card from unauthorized use. Except where required by applicable law, neither Issuer nor Mariasha Couture is responsible for and will not replace Mariasha Couture Gift Cards if lost, stolen, damaged or destroyed.

 

Misuse of the Card

 

Issuer and/or Mariasha Couture reserves the right in its discretion to suspend or terminate use of any Mariasha Couture Gift Card if Issuer or Mariasha Couture suspects any fraud or misuse

of a Mariasha Couture Gift Card. Issuer or Mariasha Couture may cancel the Mariasha Couture Gift Card at any time, without notice.

 

Property Rights

 

The consideration paid for the Mariasha Couture Gift Card, including any unredeemed balances, is the property of the Issuer.

No Warranties

​

Subject to applicable law, Mariasha Couture and Issuer make no warranties, express or implied, with respect to the Mariasha Couture Gift Cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. Neither Issuer nor Mariasha Couture assume any responsibility for any loss of any kind arising out of your use of any Mariasha Couture Gift Card. In the event an Mariasha Couture Gift Card is not functional, your sole remedy and Issuer’s and Mariasha Couture' sole liability shall be the replacement of the Mariasha Couture Gift Card at its then-current value.

 

Governing Law

The laws of the Commonwealth of Massachusetts govern the Card and the Terms and Conditions of this Agreement, without regard to choice of law principles.

 

Severability

​

If any one or more of the provisions of these Terms & Conditions shall be for any reason whatsoever held invalid, then such provisions shall be deemed severable from the remaining provisions and shall in no way affect the validity or enforceability of the other provisions of these Terms & Conditions.

 

Entire Agreement

​

Except as specifically stated otherwise, these Terms & Conditions set forth the entire understanding relating to the subject matter hereof, and all prior understandings, written or oral, are superseded by these Terms & Conditions.

PROMOTIONAL GIFT CARD TERMS AND CONDITIONS

 

The following terms and conditions (the “Promotional Terms and Conditions”) apply to Mariasha Couture gift cards or other stored value cards that are given away for free or distributed as a reward, incentive, or as part of a marketing or promotional program (“Promotional Cards”).  Promotional Cards are issued by Mariasha Couture, Inc., a Massachusetts based limited liability company ( “Issuer”).  By using, accepting and/or retaining a Promotional Card, you agree to these Promotional Terms and Conditions. Mariasha Couture reserves the right to change, amend or terminate the Promotional Terms and Conditions of the Promotional Card program at any time with or without notice in our sole discretion.

 

Use of the Promotional Card

 

You may use the Mariasha Couture Gift Card only to purchase eligible merchandise and pay for services at any Mariasha Couture location.  You may not use the Promotional Card to pay for membership dues.

 

Redemptions/Balances

 

Your use of the Promotional Card is limited to the current dollar value held on the card. You may obtain your balance by presenting your Promotional Card at any Mariasha Couture location. Promotional Cards may not be redeemed for cash.

Expiration Date

 

All Promotional Card will expire 90 days after the issuance date.
